The City of Fayetteville is accepting sealed bids from properly licensed firms for the construction of North Rupple Road. The project includes, but not limited to, the construction of North Rupple Road from West Starry Night View to West Mount Comfort Road. The Contract consists of approximately 1,800 L.F. of roadway construction with raised median, 182 L.F. of a new bridge, construction of associated earthwork and channelization, curb and gutter, sidewalk, shared use paths (trails), enclosed drainage, retaining walls, fencing, obliterating existing Rupple Road, driveways, 12 inch waterline and appurtenance, 10 inch sanitary sewer, sanitary sewer manholes, and miscellaneous items. All bids shall be submitted in a sealed envelope or package labeled Bid 17-67. All bids shall be received by Wednesday, November 29, 2017 before 2:00 PM, local time at the City of Fayetteville, Purchasing Division address listed below. All bids will be opened and read aloud immediately following the deadline. No late bids shall be accepted. The City of Fayetteville shall not be responsible for lost or misdirected bids.

Bidding documents and plans shall be obtained by the City of Fayetteville Purchasing Division electronically. No partial sets shall be issued. Addendums and updated plan holder listings will be posted on the City’s website at .

All vendors intending on bidding SHALL register as a plan holder by notifying Les McGaugh, via e-mail. When registering as a plan holder, vendors shall submit primary contact information including name of contractor, primary contact, phone number, fax number, and physical address. FAILURE TO REGISTER AS A PLAN HOLDER CAN RESULT IN YOUR BID BEING REJECTED.

A non-mandatory Pre-Bid meeting will be held Tuesday, November 14, 2017 at 10:00 AM in Room 326 at City Hall, 113 West Mountain Street, Fayetteville, AR 72701. All interested parties are encouraged to attend.

Each bid shall be accompanied by a cashier’s check from a bank doing business in the State of Arkansas or a corporate bid bond in an amount not less than five (5) percent of the amount bid. A one hundred percent (100%) performance and payment bond is required with the contract awarded and shall be file marked by the Washington County Circuit Clerk’s Office upon receipt to the City. The manufacturer shall provide stamped drawings from a licensed engineer or architect in the State of Arkansas. Attention is called to the fact that the minimum prevailing wage rates for each craft or type of worker and the prevailing wage rate for overtime work as determined by the Arkansas Department of Labor applies to a contract award of $75,000 or more.

Pursuant to Arkansas Code Annotated §22-9-203 The City of Fayetteville encourages all qualified small, minority and women business enterprises to bid on and receive contracts for goods, services, and

construction. Also, City of Fayetteville encourages all general contractors to subcontract portions of their contract to qualified small, minority and women business enterprises.

A State of Arkansas Contractor’s License is not required to bid on the project; however, no contractor shall submit a bid prior to submitting an initial application (which does not require a full audit) for licensure, and no construction contract shall be executed until the successful bidder has furnished an appropriate license issued by the State of Arkansas Contractor’s Licensing Board.

“Buy America” provisions apply to this project. The Arkansas Department of Transportation’s Standard Specifications Section 106 has requirements and restrictions for “Buy America”. Also, 23 CRF § 635.410 has all of the federal requirements for “Buy America”. This means that any permanent steel in the project must be manufactured in the US.

This Project is a Federal-Aid contract. This project requires wage rates to be paid according to Davis-Bacon Federal Wage Rates. The percentage goal for Disadvantaged Business Enterprise (DBE) Participation in this project is 10.0%

The City of Fayetteville hereby notifies all bidders that this contract is subject to applicable labor laws, non- discrimination provisions, wage rate laws and other federal laws including the Fair Labor Standards Act of 1938. The Work Hours Act of 1962 and Title VI of the Civil Rights Act of 1964 also apply.

The City of Fayetteville reserves the right to waive irregularities, reject bids, and postpone the award of any Contract for a period of time which shall not exceed beyond sixty (60) days from the bid opening date.
